Shorter NYT: Samuel A Alito is a very nice and bright judge who is conservative, yes, but not one of those mean icky-nasty ones. Why, but we found all sorts of progressives who would say nice things about him! And he has a dog! And his own coffee blend! He is, in fact, the shiznit!

Even shorter NYT: We're sitting out this hand, guys.

I know, I know: it's freaky in the extreme to contemplate that the Gray Lady is not coming out to play on this one, and very possibly we'll see a bunch of solemn, more-in-sorrow-than-in-anger explanations about why President Bush should not be allowed to destroy Western Civilization by putting this judge in SCOTUS. But as for right now; well, we forget sometimes that this is the New York Times. Alito is one of their guys - or, more accurately, he's one of their readers' guys. At the very least, he gets a nice article for the scrapbook for his grandkids to read.

Mind you, none of this explains why they went with the Althouse Op-Ed.

*Although I'm warming to Alito, I'm a bit concerned that Alito is not going to give the Fourth Amendment the proper sweep and scope of its original language, which is a key concern in this age of electronic data, biometric testing, etc.  I'm also (1) less sure that I agree with Alito on First Amendment speech clause issues, while I'm fairly certain that I see eye-to-eye with Kozinski, and (2) unsure about Alito's understanding of the executive's war powers (Kozinski, who excaped from communist Romania at age 12, likely has a keener appreciation of the dangers of executive over-reach).

I understand your concerns, and while I do not pretend to understand your champion AK47 as well you apparently do, I think we need to say thanks to W and take what we can get.  Alito is our best chance to get a balance back on the court (forgetting who appointed them, the current justices def. lean left without question).  Also, keeping in mind I am not familiar with your champion, I am assuming he is a naturalized citizen and not US born... If he is as conservative as you seem to insinuate then I would be worried the D's might hammer on this to prevent us from taking the court back from the dark side.  Besides... he's right on roe, second amend., and federalism, lets give him a little credit on other more obscure topics... *Disclaimer: just my opinion, and not a negative reflection on AK

Most of the time...but I'm pleased to see this article from the Times today, because it really does give the lie to Nina Totenberg's statements about Alito, and also further undercuts her assertions that phrases like "strict constructionist" are just "in the eye of the beholder."  

The Times:

Judge Alito won prestigious academic prizes while at Princeton and Yale Law School, where he stood out for his conservative views, which were in the minority, as well as for his civility in engaging ideological opponents.

"The notion that he's an extreme conservative is wrong," said Mark Dwyer, Judge Alito's fellow student at Princeton and roommate at Yale. "Sam is conservative because he's a straightforward believer in judicial restraint - that is, a judge's personal views should not dictate the outcome of the case."

Even in the Reagan Justice Department, where a palpable sense of conservative triumph was in the air, "I never got the sense that he thought about legal issues in an ideological way," said Mr. Manning, now a professor at Harvard Law School.

But Walter F. Murphy, an emeritus professor at Princeton who supervised Judge Alito's undergraduate thesis on the Italian Constitutional Court and has kept up with him in the years since, said his former student believed in ruling according to an "original understanding" of the Constitution.

I suppose you can either believe his former roommate and one of his professors at Princeton, or Ms. Totenberg.  Take your pick.

NYT not a watchtower by John Batchelor

Times watching unhelpful: grayperson no longer the frontline watchtower of the Dems or progressives and their kindred of paradise.

Watch moveon.org and kos the Mooreniks at Huffington and AA: they are bilious, righteous, eery, bloody-shirt waving iconoclasts: nothing to lose with a good fight.  Teeth sharpening for 06 and 08.

Alito a good battlefield, as the GOP has gotten slothful: recommend calisthenics and wit.  Fighting with a Princeton tiger in your tank is cheerful.

Radio and blogosphere much more agile to work through Alito than bigfootpress and talking heads: speed, interdependence, scholarship, errata corrections, civility, speed, speed, speed, and the useful gravity of the overread, these are the tools of a republic in bloom.
